Ok there is good news about the whole smart parts lawsuit

here it is-

Smart Parts, Inc. and National Paintball Supply, Inc. today announced the
signing of a Patent License Agreement giving National Paintball Supply
rights to make, sell, offer for sale, and distribute products covered by
Smart Partsą electronic paintball gun patents.

people, jeez, a patent license agreement costs money. that means that unless national paintball supply is sellin smart parts guns, the prices will prolly go up on other guns.

The reason NPS "bent over" for SP is that NPS sells ALOT OF ELECTROS.
For example, they are the sole distributor for Timmys, which is the "hottest" gun in paintball right now.

The funny thing is that NPS bowed to SP to protect Bob Long the day after Smart Parts served bob a notice to appear in court...

nps didnt bow to them they signed an agreement saying you dont sue us and we wont burry your *** into the ground. gino(pres of nps) has ALOT of money and could easily smash smart parts.

dye also signed an agreement because they could also take smart parts for alot of money because of the 03 shocker and its similarity to the matrix

actually,i do know that for a fact,it is put in my own words but its basically the same,u see,my dads odl teammate is the manager or something for nps and he told my dad that:P ,so dont hate if u dont know.And ur retarded if u dont think nps has lots of cash cause they do.

Smart parts has nothing IMO... They don't have a patent on any of the components inherent in a pbgun, they do't have the first electric pb gun, and they don't have a particularly strong compelling case that the shocker or impulse got ripped off.

Who ever said the thing about McDonalds suing BK because they both sell burgers is right. If SP gets through with this, then the first company to make a pb gun barrel can patent it and then sue EVERY company that makes any kind of pb barrel. Even worse, the first company to make a paintball itself can patent it, then sue almost every other company, or sell rights. After doing this, they could sell their pb's for so cheap that other companys couldn't even compete with the money they spent in the suit or buying rights that they would all stop make pb's because of loss of profits on them. This is really stupid what SP is doing because they are patenting something AFTER it was widely copied.

PLUS, I'm not a 100% sure but i think i heard somewhere that patents only last a couple years (for some odd reason 7 years comes to mind) then cannot be patented anymore.

I am guessing that NPS didn't bend over for anyone. Self-respect and ego have a lot to do with any company, such as the PSP and NXL not allowing other players into their league from the other league: protecting the league.

Same with NPS. I believe Smart Parts is trying to look good now, they've take a LOT of heat and are undoubtedly feeling the reprecussions of things. Its a culmination of these suits, their Shocker and Nerve delays, and poor customer service. I believe that Smart Parts either was the first to sign or they didn't try to fight too hard over signing or NPS may have released information...and that would have really buried Smart Parts.

Patents cannot...

1) Create a monopoly
2) Hinder growth and progress (anyone remember US History?)

The Smart Parts patent is not technically valid, rather, some moron decided to just let it go without thinking about it as things tend to go that way in the legal system.

He is a brilliant businessman though.

From a business point of view, Smart Parts is insanely smart.

From a player's point of view, it's kinda bad for the sport.

I stand somewhere in the middle on this whole issue. I mean yeah, Smart Parts is suing a bunch of people. But also, the huge paintball companies like Brass Eagle, Kingman, etc are going to go down fighting, if they do go down. Smart Parts' patent impedes technology, so it will probably get invalidated or something.

Something's gonna happen, all paintball companies will be fine, the boycott will stop, yadda yadda yadda.

I'm not worried by any means, but I do wish Smart Parts would stop. The link in my sig is way overkill, I mean paintball Nazis? Seriously, is Smart Parts killing people? Murdering Jewish women and children for pointless reasons? No. But it does get the point across I guess.

I'm set with my Trracer and JT. Even if some **** does happen, someone will find a probably better way around it that renders e-frames obsolete.

So quit worrying.

That's true. It is some where around seven years, after that, if they don't change it in sme way, it's up for grabs, and the patent is void. That is how we got coca cola classic, and vanilla coke. They have to put a new spin on it some how, or else they lose the patent.

the thing about the patents expiring does not matter in this case because what smart parts did is do something(i forget what exactly i think they kept "revising" it basically having it float along until the market was full of electros then let the broad one set in now) that made it last all these years.

To patent any electro marker, SP must prove they were the genuine designer of the first electro. And from what I hear, they're not.

Even if they are going after everything from switches to buttons on electro markers, they must prove the had invented ALL of it.

It would be like someone patenting anything with a bun, lettuce, tomato, pickles, onions and beef and charging burger king and McD's 5$ for each one they sell. Then they win the patent. Obviously this would not happen in real life, but in the sick dreams of men. Kinda like SP is doing.

Man will do anything for money. Alas this world is full of greed.:(
