Ok i have this awsome idies for a new anti chop bolt, i have all the drawing and specs but how do i get it patented? Do i have to have a working model? and if i do can i get the 'concept' patented so that whn i get someone to make it they cant steal it?

you can search for it on the web and find info. I think you have to fill out some kind of application but DO know that you dont need a woking model. You can patent the idea

First of all, make copys of everything you have. Put one copy of all the info in an envlope and mail it to yourself, but don't open the envlope. It's called the poor mans patent. That will give you some protection while you get a real patent. Real patents cost money. Contact a patent lawyer.

GET A PATENT LAWYER!!!

I can't stress that enough. The lawer will probably cost more than the patent fee, but if you try to do it yourself the patent will have more holes than a cheese grater. If it's a good idea it's worth it. Take it from someone with nine patents of their own.

I echo what everyone says, GET A LAWYER! It's not cheap but it's the best way to protect your investment.

Don't do this.

This could work but only against the most blatent attempts to steal your property, attempts that damn near any judge would see through anyway. It's better you don't have the false sense of security it provides.

Also, in searching around you are going to find companies that offer you this fantastic deal where they will take your idea, file all the appropriate patent applications and help you market your idea.

Sounds great doesn't it?

it's crap, they will make you sign a contract where they get between 50& and 80% of the profits from your patent, AFTER they recoup all of their expenses off the top.

The safest way is to get the patent before attempting to sell your idea. For firsthand experience on the dangers of not filing proper trademark,copyright, and patent information - note the current Armotech.com/Armotech.us dispute. Covering your *** is the first rule of patents.

If you are serious about this, I suggest that you file a design patent regardless of what you plan to do with it. Expect to pay about 550 dollars in filing fees and an equal amount in attorney fees.

Also, you will need someone to draft the drawings of your product. DO NOT DO THIS YOURSELF -- your attorney will be able to get you someone to draw these pictures that understands the very specific nuances of patent drawings.

We should all ask the moderator of this forum (magnus55 I think) to make a sticky on patenting ideas, considering a lot of custom ideas have the potential to make good cash.

oh, and does anyone know of a list of things that has been patented in paintball, might sound stupid but it would be cool not to get sued by BE or something

you can just patent the idea...but then later if you want to take it to the next step to actually start to produce it you have to obviously make a working model and then go through some sorta i forget what it's called....like standards or something...

That probably won't help him, there are certain problems with using a patent attorney that isn't in your state. And like every other lawyer, one that specializes in patent law must be a member of the state Bar to practice law in that state.
I strongly suggest that you look for a patent attorney in your own state. And you don't HAVE to produce a working model of the part to get the patent process rolling, but it is needed before the final patent is issued.
