The jury found that the asserted claims of NPF’s U.S. patent number 6,615,814 were valid. Earlier, on November 17, Judge John Shabaz found that the patent was infringed, as a matter of law, by Smart Parts’ Impulse, Shocker and Nerve markers. Following the jury trial, the court granted NPF’s motion for a permanent injunction, preventing Smart Parts from selling any infringing markers from December 9, 2004, forward. This injunction will last for the life of the patent, until October 14, 2019.

Does this mean they are still allowed to make these markers or are they totally screwed.

From the article, it sounds like they are totally screwed, but I'm sure that's not going to fly with SP. I assume they will just end up paying WDP royalties for using their patent. The hilarious part about it is that WDP basically bought the patent right from under SP's nose.

sorry it was in the wrong forum guys. Supposedly these patents involve the designs of IMpulse, Shockers, and Nerve markers and they were "allegedly" not be allowed to produce them after 12-9-2004, but I dont know how that played out.

IMO, it is well deserved since their lawsuits caused other markers to stop production, like AKA, and others.

WDP or NPF may just turn around the do the same thing that SP was doing to everyone, so it may not turn out to be the greatest acheivement.

We will have to wait for this to unfold and see what happens.

Who knows? Not that I plan on selling it, but if SP ends up ending production, the resale on my imp may be raised ^^

SP Will probably make a new line of markers. This means less ups, service, etc.

Man, I feel like I'm getting *******ed. I mean, if SP DOES end production, impulse, shocker, and nerve owners are boned. No SP upgrades, no service, etc.

Like I said, the lawsuit was over a data link, something that can easily be fixed. SP isn't going to halt production on their guns over something like this.

damnit i was gonna get an rat jr next spring........ im wondering if anything will get screwed or what. i dont see why everyone hates smart parts so much. i dont know wat they did. i think they make a fine product, who cares if it was done by other companies. the more the merrier, we want our sport to prosper.

ive read all the articles about it,and talked to ppl at pb2x,and people from company sponsored teams and so on. All i know of is that SP payed WDP NPF a 106.???k royalty for damages. And was originally not suppose to produce anymore markers after the 9th, but i believe that got rid of that and still are, just that they had to change stuff and that wdp got a nice chunk of money but shoulda took it a step further imo. And took SP out so AKA,ICD all that that can come back making fine new markers without higher price tags and a nice production of high quality markers.

what really ticks me off is K2/WGP/BE/JT/VL going and sueing 32 deg. and empire, bc the reloader looked like a revvy but didnt function like it bc it used a sound activated motor. Also 32 deg. getting sued for their gravity fed loader bc it looks like a vl200... so what how else can u make a gravity fed hopper? make it a square?

Paintball is just like any other industry. It is getting bigger and bigger and more money is getting involved.
People want to protect their investment and that means following the "American tradition" and suing anyone that you can.

it's gray-area business ethics, is what it is. these companies are trying to to damage their competition, both financially, and their stocks, with this kind of crap. Under the guise of protecting what they consider to be theirs.
Just my opinion, but I think that if they dropped the prices on some of these high end markers, that they could boost their sales.

You know, if either of you two chuckleheads read the thread, you'd realize it was an absolutely minimal issue.

And if you'd read about 10 posts down, you'd realize that it was overturned.
